From FIESTERS S.L. we thank you for your confidence in us and for this reason we set out below our privacy policy in order to guarantee you maximum transparency in the treatment of your data.

1. Introduction

This Privacy Policy describes how FIESTERS S.L. collects, uses, maintains and discloses information collected through our websites and app. This privacy policy applies to controlled websites, apps and all products and services offered by FIESTERS (web and app). If you do not agree to this policy, please do not access or use our Services or any aspect of our Business. Updates to this Privacy Policy reflect recent changes in data protection law under the provisions of article 11 of the Organic Law 3/2018 on Data Protection (hereinafter LOPD) and article 13 of the European Data Protection Regulation and are intended to provide Users with a clearer understanding of how FIESTERS handles all User data.

2. Applicability

This Privacy Policy applies to all products and services offered by FIESTERS S.L., including our mobile applications. In addition, this policy applies to personal data from Europe and the USA. This Privacy Policy does not apply to any third-party application or software that integrates with the Fiesters App services or any other third-party product, service, or business.

3. Data collected and received by FIESTERS S.L. 

3.1. Definition of information processing
Any operation or set of operations which is performed upon personal data or upon sets of personal data, whether or not by automated means, such as collection, recording, organisation, structuring, storage, adaptation or alteration, retrieval, consultation, use, disclosure by transmission, dissemination or otherwise making available, alignment or combination, restriction, erasure or destruction.

3.2. Personally Identifiable Information
We may collect personally identifiable information from Users in a variety of ways, including, but not limited to, when Users visit FIESTERS App, register with FIESTERS web or app, and in connection with other activities, services, features or resources we make available. Users may be asked for, as appropriate, name, email address and billing information. We will collect personally identifiable information from Users only if they voluntarily submit such information to us, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to that natural person's physical, sexual identity, sexual orientation and preferences, physiological, genetic, mental, economic, cultural or social identity. Users can always refuse to provide personally identifiable information, unless it obstructs their participation in certain FIESTERS S.L. related activities. Real names and billing information are encrypted on FIESTERS App servers. We will never sell your personal information to third parties or use your name or company name in any marketing statements without obtaining your written permission.

3.3. Non-Personally Identifiable Information
We may collect non-personal identification information about Users whenever they interact with FIESTERS App. Non-personal identification information may include browser name, type of equipment and technical information about the means Users use to connect to FIESTERS App, such as the operating system and internet service providers used and other similar information.

3.4. Other information
Services metadata: when Users interact with our Services, metadata is generated to help provide additional context about how Users interact with FIESTERS web and FIESTERS App.
Log Data: Our Services will automatically collect information when Users and FIESTERS Administrators access or use our Services and record it in log files. Log data may include IP address (or a shortened version thereof), addresses of previously visited web pages, browser type and settings, time and date the Services were used, browser settings and plug-ins, language and cookie data. Device information: FIESTERS S.L. collects information about your computer, phone, tablet or other devices that you use to access our Services. This device information includes your connection type and settings when you install, access, update or use our Services. We also collect information through your device about your operating system, browser type, IP address, referring/exit page URLs, device identifiers and crash data. We use your IP address and/or country preference to approximate your location and provide you with a better Service experience. The amount of this information we collect depends on the type and configuration of the device you use to access the Services.
Personal information: FIESTERS App is a communication and dating app as well as a community tool, therefore, any information generated by the user through the use of our services will be collected and stored by FIESTERS S.L.. The data collected includes, but is not limited to, data that users post, send, receive or share. This includes any files or links that the User uploads to our Services, including images and videos, public or private. It also includes all forms of personal information provided by the User in their User profile. Personal data will only be accessible through authorised and limited Administrator accounts or an account designated by Users and may only be viewed or altered by Users belonging to such accounts. FIESTERS S.L. will never share, sell or exploit any personal information unless specifically requested by the User through written consent. Any advertising directed to Users will be done anonymously. Users may also request log data of their account accesses to see which potential users of the Administrator accessed.

5. How FIESTERS S.L. uses the collected data

Users are primarily responsible for User data. FIESTERS S.L. will never remove Users from the FIESTERS App unless specifically instructed to do so by the User, or if the User violates the Terms and Conditions or breaches FIESTERS App regulations.

FIESTERS App collects and uses Users' personal information for the following purposes:

  • To personalise the user experience and improve our sites and apps.
  • We may use information in the aggregate to understand how our Users, as a group, use the services and resources offered on FIESTERS App.
  • To send Users information that they have agreed to receive about topics we think may be of interest to them, in the form of newsletters, alerts or other "push" technologies.
  • We may also use your email address to send information that, in some cases, is targeted to your interests, such as advertising banners and promotions, through explicit consent.
  • We also send you periodic informational updates via email, through explicit consent.
  • The email address provided by users will only be used to respond to their enquiries, and/or other requests or questions. If the User chooses to join our mailing list, they will receive e-mails that may include company news, updates, product or service related information, etc., through explicit consent. If at any time the User wishes to stop receiving future emails, we include detailed unsubscribe instructions at the bottom of each email.
  • As required by applicable law, legal process or regulation.
  • For billing, account management and other administrative matters, to which only specific FIESTERS App billing managers have access.
  • For investigation and prevention measures against abuse of FIESTERS App. FIESTERS App accesses are recorded in the user log file and the user log file can be requested and disputed at any time.

6. Sharing and Disclosure of Information

FIESTERS App will only disclose or share User information for purposes triggered by the User such as contact requests or any other interaction on FIESTERS App, as well as to preserve legal compliance. 

7. Servers and infrastructure: GDPR information

Operational partners: FIESTERS App works with third parties who provide billing services and technical support to deliver and implement solutions to our users. FIESTERS App may share User information with these third parties in connection with their services, such as to assist with billing cycles, to provide localized support, and to provide customization work. FIESTERS App may also share information with these third parties when users have given their consent to share any information, for example, technical or customer support services.

Links to Third Party Websites: The FIESTERS App Services may include links that direct you to other websites or services whose privacy practices may differ from ours, such as Content Providers. What you submit to these third party sites is governed by their privacy policies and is not covered by FIESTERS S.L.'s privacy policies.

Third party widgets: Our Services may contain social media widgets and features, for example, the Twitter "tweet" button or similar. These widgets and features collect your IP address and may set a cookie in order for the feature to function properly. Social media widgets and features are either hosted by a third party or hosted directly on our Services. Your interactions with these features are governed by the privacy policy of the company providing them and not by FIESTERS S.L.'s Privacy Policy.

FIESTERS App operations require our employees to have access to systems that store and process user data. This is primarily for troubleshooting or problem resolution purposes. For example, in order to diagnose a problem Users may have with FIESTERS App services, our employees may need access to their User data. All employees and affiliated subcontractors are prohibited from viewing User data for any reason unless it is absolutely necessary to do so.

8. Removal of data

If Users require removal of their data, it is necessary for Users to delete their account. When Users delete their account or decide to stop participating in the Services, the removal of data will be carried out as follows: most of the data will be removed with the consent of the User. Complete removal of data is automatic and immediate.

9. Security

At FIESTERS S.L. we take the security of your data very seriously. As transparency is one of the principles on which our company is based, we aim to be as clear and open as possible about how we manage security.

10. Age limitation

FIESTERS S.L. does not permit the use of our FIESTERS App Services by any person under the age of majority in the relevant state and country of the Users.
In the event that FIESTERS S.L. becomes aware that any person under that local legal age has unlawfully provided us with personal data, FIESTERS S.L. will take the necessary steps to remove such information. FIESTERS App is strictly an adult oriented service, therefore all minors are prohibited from using any and all of the services provided.

11. Changes to the Privacy Policy

FIESTERS S.L. has the discretion to update this Privacy Policy at any time. We encourage users to frequently review this page for any changes to how we are helping to protect the personal information we collect. You acknowledge and agree that it is your responsibility to review this privacy policy periodically and become aware of modifications.

12. Privacy Shield

In compliance with the U.S. and EU Privacy Shield Principles, FIESTERS S.L. will make every effort to resolve complaints about User privacy and our collection of their personal information. Users who have questions or complaints regarding our Privacy Policy should contact FIESTERS S.L.'s Data Protection Officer with any questions regarding our Privacy Policy. Please note that, if complaints cannot be resolved through the channels listed here, under limited circumstances a binding arbitration option before a Privacy Shield Panel may be available.

13. User rights

Users have certain legal rights in relation to their personal data.
Data subjects' rights of access include the following:

  • Know whether a data controller holds personal data about them.
  • Receive a description of the data held and a copy of it.
  • Be informed of the purposes for which the data is being processed and where it has been received.
  • Be informed whether the information is being disclosed to anyone other than the original recipient of the data; and if so, the identity of those recipients.
  • The right to data portability. The data subject may request the transfer of his or her personal data to him or herself or to a third party in machine-readable form (Word, PDF, etc.). However, such requests may only be granted if the data concerned are: 1) provided by the data subject to FIESTERS App, 2) processed automatically, and 3) processed on the basis of consent or pursuant to a contract.
  • If the data are used to make automated decisions concerning the data subject, the data subject will be informed of the logic used by the system to make such decisions and to enable the human intervention to be requested.
    FIESTERS S.L. must respond to data subjects who request access to their data within 60 calendar days of receipt of the data subject's request for access, unless local law provides otherwise.
    In order to establish the correct identity of the User, FESTERS S.L. may require the User to provide official government-issued proof of identity or require secondary digital validation.

14. There are no guarantees for factors beyond FIESTERS S.L.'s control.

While this Privacy Statement expresses FIESTERS S.L.'s standards for the maintenance of privacy, it is not able to guarantee that the standards will always be met. There may be factors beyond FIESTERS S.L.'s control that may lead to the disclosure of data. In this event, FIESTERS S.L. disclaims all warranties or claims relating to the maintenance of privacy and non-disclosure of private information.
